While the fate of the Affordable Care Act (ACA) remains uncertain, the employer mandate and its exhaustive reporting requirements still apply to employers nationwide. The IRS has continued to enforce ACA requirements aggressively by sending Letter 226J penalty notices for noncompliance with the Employer Shared Responsibility Payment (ESRP) provisions 4980H(A & B). Initially, enforcement focused on the 2015 and 2016 tax years. Now, the IRS has turned its attention to the 2017 tax year. With employers facing the highest penalty amounts yet for ACA non-compliance, it’s more important than ever for companies to review their ACA responsibilities.
As reporting regulations continue to evolve, employers can’t afford to be unfamiliar with the newest changes related to the ACA. Our ACA webinar is designed to educate employers on essential reporting and filing requirements to avoid falling victim to skyrocketing penalty assessments.

Mary V. Bauman is an attorney at Miller Johnson in Grand Rapids, MI. She works with employers in establishing, amending, and terminating employee benefit plans of all types. She often plays a consulting role to help the employer strategize ways to better control plan costs and achieve human resources objectives in connection with a plan. In addition, she represents several clients who perform various aspects of employee benefit administration. Ms. Bauman is the chair of the firm’s employee benefits and executive compensation practice group, and health care reform team.
