On December 17th, the 6th Circuit Court of Appeals lifted the stay on the Occupational Safety and Health Administration’s (OSHA) rule that employers with 100 more employees must require workers receive their COVID-19 vaccination or be tested weekly and wear masks while onsite.
Though this mandate, the Emergency Temporary Standard (ETS), is active again, it is already being appealed and could be held up again.
The previous deadline to comply with this mandate was December 6th, 2021, while the deadline to begin testing unvaccinated employees was January 4th. The compliance deadline has now been extended to January 10th, 2022. However OSHA has addressed that compliance will be difficult for many employers with the small amount of time between now and the new deadline, saying, “To provide employers with sufficient time to come into compliance, OSHA will not issue citations for noncompliance with any requirements of the ETS before January 10 and will not issue citations for noncompliance with the standard’s testing requirements before February 9, so long as an employer is exercising reasonable, good faith efforts to come into compliance with the standard. OSHA will work closely with the regulated community to provide compliance assistance.”
